HOW DOES IT WORK?

In a typical Florida real estate acquisition transaction, the seller "customarily" may offer 6% total commission. 3% of which goes towards seller’s listing agent/broker and the remaining 3% is reserved for the buyer’s agent/broker. Every real estate transaction is unique and the total commission and split offered by the seller may vary by transaction.

 

When a buyer is being represented by a traditional Real Estate Brokerage, the real estate agent/broker is NEVER obligated to rebate any portion of the received commission back to the buyer. On the other hand, when a buyer is being professionally represented by Mw International Realty, Mw International Realty will rebate the predetermined, agreed percentage of their portion of the SELLER PAID commission back to the buyer at closing.

Real estate has changed. Today, many buyers prefer to search for properties online. The traditional real estate model is still playing by the old rules, but at Mw International Realty, we feel that buyers should be rewarded for all of their efforts. With today's technology, buyers can search for properties and communities anytime and anywhere - on a desktop, laptop, tablet, or cellphone.

 

When you are ready to buy, you can simply go to the Builder's model on your own, without representation, pick out the home and options you like, and sign the contract. BUT if you do that, you'll be leaving money on the table! 

 

If you are being represented by most real estate agencies, you will not get any rebate, cash back. There are some that offer similar services but none can come close to our rebates.

 

Almost all builders WILL NOT reduce their selling price just because you don’t have representation. They simply will keep the reserved buyer’s agent/brokerage commission.

Is It Legal?

Are Rebates Legal?

 Rebates are absolutely LEGAL in the State of Florida. According to The United States Department of Justice, rebates are allowed in most states including The State of Florida. Florida Statutes section 475.25(1)(b) or (d) declares that rebates are allowed with disclosure to other interested parties in the transaction.

Mw International Realty will only distribute rebates at the closing.

61J2-10.028 Kickbacks or Rebates.

(1) Any real estate licensee who receives, or makes any arrangement or agreement to receive, directly or indirectly, any kickback or rebate, for the placement of, or favor in, any business transaction which forms a part of, or is incident to, any transaction(s) negotiated or handled by said licensee, is a violation of Section 475.25(1)(b) or (d), Florida Statutes, or both of said subsections of the Florida Statutes, unless prior to the time of the placement of, or favor in, said business transaction, the licensee shall have fully advised the principal if any and all affected parties in the transaction(s), which the licensee is handling, of all facts pertaining to the arrangement of kickbacks or rebates.

(2) The sharing of brokerage compensation by a licensee with a party to the real estate transaction with full disclosure to all interested parties is not considered a violation of Chapter 475, Part I, Florida Statutes.

Are Rebates Taxable by IRS?

Real estate rebate can be a pretty significant dollar figure, and for that reason, many people think they may be taxable and/or their agent/broker will have to issue them a 1099.  But this is an incorrect misperception.

 

The reality is a real estate rebate is just a reduction in the cost of a home you buy, no different than a manufacturer rebate on a home appliance.

 

 It is not considered income, therefore it is NOT taxable.

 

The IRS has provided an opinion on this subject, and determined that real estate rebates are not taxable. You can read more about the IRS's position on the matter from the provided PDF.

 

Since the rebate is not taxable, a 1099 will not be issued to you.
